Terms of Service

1.1 Agreement. By accessing or using MidasLotto, you enter into a binding contract with us. These Terms apply to all users, including visitors, registered members, and any other persons who access the platform.

1.2 Eligibility. You must be at least 18 years of age and a resident of Nigeria to use our services. By using MidasLotto, you represent and warrant that you meet these requirements.

1.3 Modifications. We reserve the right to modify these Terms at any time. We will notify you of material changes via email or platform notice at least 30 days before the changes take effect. Your continued use after changes constitutes acceptance of the modified Terms.

2.1 License Grant. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the MidasLotto platform for personal, non-commercial purposes.

2.2 Regulatory Compliance. MidasLotto operates under an interactive gaming license issued by Nigerian regulatory authorities. All raffle draws are conducted in accordance with Nigerian gaming laws and regulations.

2.3 Platform Availability. We strive to maintain platform availability 24/7, but we do not guarantee uninterrupted access. We may suspend or restrict access for maintenance, security, or regulatory compliance purposes without prior notice.

2.4 Geographic Restrictions. Our services are available only to residents of Nigeria. You may not use VPNs or other methods to circumvent geographic restrictions.

3.1 Account Creation. To participate in raffle draws, you must create an account with accurate, complete, and current information. You may only create one account per person.

3.2 Identity Verification. We may require you to provide identification documents to verify your age, identity, and eligibility. Failure to provide requested documentation may result in account suspension or closure.

3.3 Account Security. You are responsible for maintaining the confidentiality of your login credentials. You must not share your account with others. You agree to notify us immediately of any unauthorized access or security breach.

3.4 Account Suspension. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose security risks.

4.1 Entry Purchase. You may purchase entries to participate in raffle draws. Each entry provides a chance to win prizes as specified in the draw details. Entry purchases are final and non-refundable except as required by law.

4.2 Draw Mechanics. Winners are selected through a random draw process that ensures fairness and transparency. Draw dates, times, and prize details are clearly communicated on the platform.

4.3 Prize Claims. Winners will be notified via email and platform notification. Prizes must be claimed within the specified timeframe (typically 30 days). Unclaimed prizes will be forfeited.

4.4 Prize Distribution. Cash prizes will be transferred to your registered bank account. We reserve the right to verify winner identity before prize distribution. Taxes and fees associated with prizes are the sole responsibility of the winner.

4.5 Dispute Resolution. All decisions regarding draw outcomes and prize awards are final. Disputes must be submitted in writing within 7 days of the disputed event.

5.1 Payment Methods. We accept payments through authorized payment processors including Paystack. All transactions are processed securely using industry-standard encryption.

5.2 Payment Authorization. By providing payment information, you authorize us to charge your selected payment method for entry purchases. You represent that you have the legal right to use the payment method provided.

5.3 Transaction Fees. All prices are displayed in Nigerian Naira (NGN) and include applicable transaction fees. We are not responsible for fees charged by your bank or payment provider.

5.4 Failed Transactions. If a payment fails, we may suspend your account or void entries until payment is resolved. We are not liable for losses resulting from payment failures.

5.5 Refunds. Entry purchases are generally non-refundable. Refunds will only be issued in cases of technical errors, canceled draws, or as required by law.

You agree not to:

Violation of these prohibitions may result in immediate account termination, forfeiture of prizes, and legal action.

7.1 Ownership. All content, features, functionality, trademarks, logos, and intellectual property on the MidasLotto platform are owned by us or our licensors. You may not use, reproduce, or distribute any content without our express written permission.

7.2 User Content. By submitting content to our platform (such as profile information or communications), you grant us a worldwide, royalty-free license to use, display, and process such content as necessary to provide our services.

7.3 Copyright Infringement. We respect intellectual property rights. If you believe content on our platform infringes your copyright, please contact us with detailed information.

8.1 "As Is" Basis. The platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee that the platform will be error-free, secure, or uninterrupted.

8.2 Limitation of Liability. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including lost profits, data loss, or business interruption.

8.3 Maximum Liability. Our total liability for any claim arising from these Terms or your use of the platform shall not exceed the amount you paid to us in the 12 months preceding the claim.

8.4 Third-Party Services. We are not responsible for the actions, content, or services of third-party payment processors or other service providers.

You agree to indemnify, defend, and hold harmless MidasLotto, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from: (a) your violation of these Terms; (b) your violation of any law or third-party rights; (c) your use of the platform; or (d) any fraudulent or illegal activity.

10.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to conflict of law principles.

10.2 Dispute Resolution. Any dispute arising from these Terms or your use of the platform shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through arbitration in Lagos, Nigeria, in accordance with Nigerian arbitration laws.

10.3 Jurisdiction. You consent to the exclusive jurisdiction of the courts located in Lagos, Nigeria for any disputes that cannot be resolved through arbitration.

11.1 By You. You may terminate your account at any time by contacting customer support. Termination does not entitle you to refunds of entry purchases.

11.2 By Us. We may suspend or terminate your account immediately without prior notice if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.

11.3 Effect of Termination. Upon termination, your right to use the platform ceases immediately. Provisions regarding intellectual property, disclaimers, indemnification, and dispute resolution survive termination.

12.1 Entire Agreement. These Terms, together with our Privacy Policy and Responsible Gaming Policy, constitute the entire agreement between you and MidasLotto.

12.2 Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12.3 Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

12.4 Assignment. You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

12.5 Force Majeure. We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, or technical failures.
