By registering or using the Midas Lotto platform, You confirm that You have read, understood, and agree to be bound by these Terms. If You do not agree with these Terms, do not use the platform.
Continued use of the platform constitutes acceptance of any future updates.

Midas Lotto may modify or update any part of these Terms & Conditions at any time for various reasons, including but not limited to compliance with applicable laws, regulatory requirements, internal policies, or operational needs.

Any updated version of the Terms will be published on the Midas Lotto website, together with the effective date of publication. You are encouraged to review the Terms regularly. It is your responsibility to ensure that you understand the Terms as they apply to your continued use of the platform.

If any part of the Terms, including any updates or modifications, is unacceptable to you, you must discontinue use of the Midas Lotto website, mobile application, your account, and all related services.

4.1 Account Requirement
You must register a personal Midas Lotto Account to access or use any of our Services. You must choose a username that is not offensive, misleading, or deceptive. Midas Lotto may change usernames that violate policy. You are solely responsible for safeguarding Your login credentials. Midas Lotto reserves the right to refuse the registration of any Account, with or without providing a reason.

4.2 Eligibility, Representations & User Obligations
(a) By registering an Account, you represent, warrant, and agree that:

(i) You are at least 18 years old or the legal age of majority in your jurisdiction;
(ii) You will provide accurate, complete, and verifiable information during registration, including full name, date of birth, residential address, country of residence, email address, phone number, and Nigerian bank account details and you will promptly update us if any of these details change;
(iii) You are opening the Account for your personal use only, acting on your own behalf and not for or on behalf of any third party;
(iv) You are legally capable of entering into binding agreements, including these Terms & Conditions and any subsequent transactions or game participation on the platform.

(b) Ineligible individuals include Midas Lotto employees, Contractors, agents, or vendors involved in operations and Immediate family members of the said groups.

(c) Midas Lotto reserves the right to verify your age and identity at any time.

(d) We are not responsible for any abuse or misuse of your account by third parties due to your disclosure, whether intentional or accidental, whether active or passive, of your login details to any third party.

(e) We will never request your password via phone, SMS or email.

(f) If you breach Clause 4.2(a) or if any of your representations or information are found to be false, inaccurate, or misleading, Midas Lotto may:
(i) Cancel any pending wins or rewards;
(ii) Refuse to pay any winnings associated with the breach;
(iii) Suspend or permanently terminate your Account;
(iv) Report the matter to law enforcement, regulatory authorities, or appropriate parties where required.

4.3 Verification & Compliance Checks
By registering an Account or using any Midas Lotto Service, you consent to all identity, age, credit, and security verification checks we consider necessary or that are required by applicable laws, regulations, or regulatory authorities. You agree to provide any information or documentation requested in relation to these checks.

Midas Lotto may suspend, restrict, or limit access to your Account or certain Services until all verification checks are successfully completed to our satisfaction.

If verification cannot be completed, or if any information provided is false, incomplete, or unverifiable, Midas Lotto may:
(i) Void wins or transactions;
(ii) Suspend or permanently close your Account;
(iii) Forfeit any remaining balance associated with the breach.

Midas Lotto may engage reputable third-party partners to conduct verification checks. All information provided during registration or verification will be processed in accordance with our Privacy Policy. It is your responsibility to ensure that your registration details remain accurate and up to date at all times.

4.4 Non-Transferability of Accounts
You may not buy, sell, transfer, assign or otherwise dispose of your Midas Lotto Account to any other User or third party. You must not acquire or accept the transfer of another User’s Account under any circumstances.

Tickets may be purchased online through the Midas Lotto website or mobile app and at any authorized physical sales outlet. Midas Lotto may redesign or update ticket formats at any time for security or anti-counterfeit purposes. All purchases are final once processed.

Winners are determined using a certified Random Number Generator (RNG) in compliance with National Lottery Regulatory Commission (NLRC) standards. Users may purchase multiple tickets to increase their chances. Draw results are final and cannot be altered.

Cash prizes are paid directly into the verified Nigerian bank account registered to Your profile. You must report any missing or failed transaction within 3 days of the win. Failure to report within this timeframe is deemed acceptance of the payout.

Midas Lotto is not liable for delays caused by banks, incorrect account information provided by the user or negligence or misuse by the prize winner

If a physical item cannot be delivered, Midas Lotto may substitute with an item of equal value or its monetary equivalent.

8.1 Deposits
A. Any bank account you register on your Midas Lotto Account whether during registration or later must be a Nigerian bank account opened and operated in your name only.

You are strictly prohibited from funding your Midas Lotto Account using:
i. A bank account or payment method belonging to another person;
ii. Funds supplied to you by another person for the purpose of playing, depositing, or gaming on their behalf.

This does not limit any other remedies available to Midas Lotto if you use another person’s payment method without authorization.

B. If Midas Lotto determines that a deposit was made using a third-party account, card, wallet, or funds:

i. We may refund the deposit directly back to its original source
ii. If this determination is made after you have already played, all affected plays or games will be voided
iii. Midas Lotto will not be obligated to pay any winnings associated with such transactions
iv. We will not reimburse any losses incurred before the detection of the violation.

C. Midas Lotto does not charge fees for deposits made through bank transfer, debit cards, credit cards, or approved payment providers. However, your bank or payment provider may apply their own charges, which are outside our control.

D. Minimum and maximum deposit amounts may apply depending on the payment method used. You may only participate in games or draws up to the amount available in your Midas Lotto Account, and are subject to the applicable minimum and maximum limits for each game or service.

E. You may deposit funds using approved payment methods (bank transfer, card, wallet providers). Midas Lotto may request proof of ownership of payment instruments. Deposits made using third-party accounts or funds may be reversed. Your account may be suspended until verification documents are provided.

F. Your Midas Lotto Account is provided solely for accessing our Services under these Terms. It must not be used as a bank account, money-transfer channel, or wallet, and it will not generate any interest. If your activity suggests that you are depositing or withdrawing funds without genuine gameplay, Midas Lotto may suspend or restrict your Account, conduct a full investigation of the activity or terminate your account if misuse is confirmed. In such cases, Midas Lotto reserves the right without prior notice to deduct from your Account any bank fees or charges incurred due to the improper transactions.

8.2 Withdrawal
A. You may withdraw the available cash balance in your Midas Lotto Account including winnings earned from gameplay funded by your cash balance by submitting a withdrawal request through the platform.

B. Withdrawals may be made only into your verified Nigerian bank account, registered under your Midas Lotto Account, in accordance with the rules governing bank account ownership under these Terms.

C. Midas Lotto reserves the right to reject or delay any withdrawal request if: The transaction appears to involve funds moved between different payment methods without genuine gameplay, the withdrawal involves un-played or partially un-played deposits, You fail to provide satisfactory proof that the payment method used belongs to you or the activity suggests money laundering, fraud, or any attempt to misuse the platform. And in such cases, Midas Lotto may suspend the Account pending investigation.

D. Midas Lotto may carry out identity, payment method, and compliance verification checks at any time, including at the point of withdrawal. This may be required by law, regulators, third-party providers, or internal policy. During verification withdrawal methods may be temporarily disabled, withdrawal processing may be paused or Your Account or access to Services may be suspended until verification is completed to our satisfaction.

E. You may be required to provide one or more of the following documents; valid government-issued ID (front and back), For card transactions, a copy of the card showing only the last four digits, a recent (not older than one month) statement such as a bank statement or debit card statement showing your name, address, bank account number, relevant Midas Lotto transactions (if applicable) and any additional documents necessary to complete verification.

F. Withdrawals are generally processed within 5 banking days, subject to successful verification. Midas Lotto is not liable for delays caused by banks, payment processors, or service providers.

G. Withdrawals may only be made to Your verified Nigerian bank account.

H. The User shall not attempt any charge-backs, reversals or otherwise cancel any deposit previously made into the Account. If we incur any charge-backs, reversals or other charges in respect of your Account, we reserve the right to charge you for and/or set off from your Account balance the relevant amounts incurred.

I. You are responsible for reporting your winnings to the tax and/or other authorities as may be applicable from time to time.

8.3 Payment Method Restrictions
Midas Lotto reserves the right to update, modify, or change the payment methods we accept at any time.

In addition, Midas Lotto may, at its sole discretion and without providing a reason, decline or refuse to accept any payment method presented by you, even if we have previously accepted that method from you, or that method is generally accepted for other Users.

Midas Lotto is under no obligation to accept any particular payment type, and acceptance may vary based on security, regulatory, or operational considerations.

8.4 Fraud / Misrepresentation
A. Midas Lotto is committed to full compliance with all applicable Nigerian laws and regulations relating to anti–money laundering, counter-terrorism financing, financial crimes, and fraudulent transactions, including guidelines issued by the Central Bank of Nigeria (CBN), the Nigerian Financial Intelligence Unit (NFIU), and the National Lottery Regulatory Commission (NLRC).

B. You agree not to use the Website, your Account, or any of the Services for any unlawful, criminal, or illegitimate purpose, including but not limited to depositing or withdrawing funds derived from criminal activity; using the Account as a channel to transfer funds disguised as gameplay; attempting to obscure the source of funds (layering); acting on behalf of another person without authorization; structuring deposits or withdrawals to avoid reporting requirements.

C. Midas Lotto reserves the right at any time to request additional documentation to verify your identity, address, source of funds, or ownership of payment instruments, delay, block, or refuse any deposit or withdrawal if suspicious activity is detected or report any suspicious or unusual transactions to the relevant authorities, including banks, NFIU, CBN, or law enforcement.

D. If we determine or reasonably suspect that you have engaged in money laundering, terrorism financing, or any related illegal activity, Midas Lotto may, without prior notice suspend or permanently close your Account, freeze or forfeit funds associated with the suspicious activity, void any games, winnings, or bonuses, restrict access to the Website or Services and cooperate fully with investigative bodies by providing information and documentation as required by law.

E. You acknowledge that Midas Lotto is legally obligated to comply with AML/CTF laws and may be restricted from informing you of certain investigations or regulatory reporting activities.

The cash prize or product will be delivered to the account details or address specified by the user. All technical service and product support matters must be taken up directly with the manufacturer in the case of products according to their terms. In case of cancellation of an order by You, the cash price or product is deemed to have been forfeited.

By participating in any Midas Lotto game, promotion, or draw, and by accepting any prize (cash or physical items), You expressly grant Midas Lotto and its affiliates the unrestricted right to use Your name, photograph, image, video, likeness, statements, and any other representation of Your identity (“Likeness”) for promotional, marketing, advertising, and publicity purposes.

This includes use on: our website, mobile applications, social media platforms, online and offline advertisements, press release and winner announcements and any other media format known or developed in the future.

You agree and acknowledge that:
i. Where a User records winnings above N25,000 (Twenty Five Thousand Naira), the User may be required to provide a photograph and/or video confirmation for verification, fraud prevention, promotional and prize validation purposes prior to the release of such winnings.

ii. Midas Lotto may use Your Likeness without additional payment or consideration.

iii. Midas Lotto may edit, adapt, or modify any photos, videos, or content for marketing purposes without requiring further approval from You.

iv. Midas Lotto will ensure that all such uses comply with the Nigeria Data Protection Act 2023 and its data privacy obligations. Your personal data will not be used in a misleading, defamatory or harmful manner.

v. You grant Midas Lotto a worldwide, perpetual, royalty-free, irrevocable, and sublicensable license to use Your Likeness for promotional purposes by accepting these Terms and Conditions and participating on the Platform.

vi. You acknowledge and agree that, to the extent permitted by law, this consent and license shall be irrevocable in respect of any materials already created, published, or relied upon and you waive any right to compensation, approval, or claims arising from such use.

vi. Where a user refuses to grant consent required under this Clause for the use of their images for promotional and publicity purposes, such refusal shall constitute a failure to satisfy the conditions attached to the relevant winnings and the User shall forfeit any entitlement to such winnings, without any liability arising against Midas Lotto.

i. Termination by User: You may close Your account at any time by contacting customer support.

ii. Termination by Midas Lotto: We may suspend or permanently close Your account for: fraud or attempted fraud, violation of these terms, misuse of payment methods, multiple accounts, use of bots or automation, providing false information and underage participation.
Midas Lotto may withhold prizes or funds associated with violations.

i. You agree that your use of the Website, the mobile application, and any of the Services is entirely at your sole risk.

ii. Midas Lotto shall not be liable for any damages, liabilities, or losses of any kind (whether direct, indirect, incidental, special, or consequential) deemed or alleged to have arisen out of or in connection with the Website, any content on it, the Account, and/or the Services. This includes, without limitation; delays or interruptions in operation or transmission, communication or network failures, misuse of the Website, mobile application, Account, or Services by any person or any error, technical fault, or malfunction.

iii. Midas Lotto shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for loss of business, loss of profits, loss of revenue, loss of data, loss of opportunity, loss of goodwill or reputation or any special, indirect or consequential loss arising from or in connection with your use of the Website, the Services, your Account, or these Terms, even if such losses were foreseeable or you had notified us of the possibility of such losses.

iv. Midas Lotto is not responsible for any loss of content, data, or material uploaded, transmitted, or otherwise sent through the Website, mobile application, or the Account.

v. Midas Lotto will not be liable to you or any third party for any modification, suspension, or discontinuance of the Services or any part thereof. Midas Lotto reserves the right to cancel, suspend, or alter the Services without liability of any kind.

vi. Midas Lotto shall not be liable for any loss or damage resulting from events outside our reasonable control, including but not limited to acts of God, power outages, labour or trade disputes, actions or failures of governmental or regulatory bodies, interruptions or failures of telecommunication systems or networks, delays or failures caused by third parties.

vii. Midas Lotto’s maximum liability to you arising out of these Terms, whether for one incident or a series of related incidents, and whether in contract, tort (including negligence), or otherwise, shall be limited to the amount of the relevant stake or bet to which the liability relates; and where funds legitimately deposited by you have been misplaced through our error, the replacement of the same amount in your Account.

Nothing in this Clause limits Midas Lotto’s obligation to pay winnings or other amounts properly due to you, subject always to these Terms and applicable maximum winnings limits.

viii. Claims for damages by the User against Midas Lotto, its directors, officers, employees, agents, contractors, or any third parties assisting in service delivery are strictly prohibited, except where such liability cannot be excluded under applicable law.

ix. Nothing in these Terms shall exclude or limit Midas Lotto’s liability where such exclusion or limitation is prohibited under applicable law.

i. Midas Lotto may from time to time offer bonuses, promotional offers, special reward programs, or incentives. Details of such offers will be made available on the Website, within your Account dashboard, or on the help/support pages.

ii. Eligibility, participation, and benefits under any bonus, promotion, or reward program are strictly subject to the specific terms and conditions governing that offer. These terms will always be accessible on the Website.

iii. Midas Lotto reserves the right, at its absolute discretion and without prior notice, to refuse participation in any bonus, promotion, or reward program, suspend or terminate access to such offers, modify or vary the terms of any offer, or discontinue any promotional program entirely.

iv. Midas Lotto shall have no obligation to provide reasons for such decisions.

i. Midas Lotto is committed to promoting Responsible Gaming. Playing should be an enjoyable pastime, and we encourage Users to engage responsibly and not gamble beyond their financial means.

ii. We take steps to raise awareness of problem gambling and encourage Users to clearly separate gaming from daily financial responsibilities, consider the duration of each gaming session before starting, and avoid treating gaming as a source of income or a method to recover losses or debts.

iii. Midas Lotto supports prevention, intervention, and assistance in addressing gambling-related harm.

iv. Users may request temporary or permanent self-exclusion from any or all Services at any time. This can be done through Customer Support or directly within the Account settings.

v. While Midas Lotto will take reasonable steps to enforce self-exclusion, the User acknowledges that Midas Lotto is not liable if the User circumvents these measures through intentional or fraudulent means.

ii. All implied warranties of fitness for purpose, accuracy, completeness, reliability, or satisfactory quality are excluded to the fullest extent permitted by law.

iii. Midas Lotto does not guarantee the uninterrupted provision of information or data on the Website, the accuracy or reliability of such information, that the Services will meet your requirements, that the Services will be free from delays, errors, defects, viruses, or security vulnerabilities, or that defects will be corrected.

iv. Data and game results provided on the platform are informational and should not be relied upon as financial advice.

A. All intellectual property rights in and to the Midas Lotto platform, including but not limited to its trademarks, logos, service marks, domain names, designs, layout, graphics, text, software, databases, game content, promotional materials, and all other proprietary information or materials (“Midas Lotto Content”), are owned by Midas Lotto or licensed to us by third parties. Such rights are protected by copyright, trademark, and other applicable intellectual property laws.

B. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and the Midas Lotto Content solely for your personal, non-commercial use and strictly in accordance with these Terms. Nothing in these Terms grants you any rights, title, or interest in the Midas Lotto Content, except for the limited licence expressly provided above.

C. You agree that you shall not, and shall not permit any third party to copy, reproduce, modify, adapt, publish, distribute, or create derivative works from any Midas Lotto Content, reverse-engineer, decompile, or otherwise attempt to extract the source code of the Platform, remove, obscure, or alter any copyright, trademark, or proprietary notices, use any automated systems (such as bots, scrapers, or data-mining tools) to access or interact with the Platform without our prior written consent, use the Midas Lotto name, trademarks, or logos without express written permission.

D. If you submit or upload any content to the Platform (including comments, testimonials, feedback, suggestions, or other materials), you grant Midas Lotto a worldwide, irrevocable, royalty-free, transferable licence to use, reproduce, modify, adapt, publish, translate, and distribute such content for operational, promotional, or business purposes. You represent that you own or have lawful rights to such content and that it does not infringe any third-party rights.

E. Midas Lotto reserves the right to take appropriate legal action against any user or third party who infringes our intellectual property rights, including suspension or termination of accounts, civil claims, or criminal complaints where applicable.

If any provision of the Terms is found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of the Terms which shall remain in full force and effect. In such instances, the part declared invalid or unenforceable shall be amended in a manner consistent with the applicable law to reflect, as closely as possible, Midas Lotto’s original intent.

A. Internal Complaint Procedure:
If you have any complaint or dispute arising from your use of the Platform, you must first contact Midas Lotto customer support via our official channels. We will review and attempt to resolve the issue within a reasonable timeframe. You agree not to commence any external dispute process until you have completed this internal complaint procedure.

B. Negotiation and Mediation
Where a dispute remains unresolved after the internal complaint procedure, both parties shall attempt in good faith to resolve the dispute through negotiation. If negotiation fails, the parties agree to submit the dispute to mediation at any recognized mediation centre in Nigeria (including the Lagos Multi-Door Courthouse or Abuja Multi-Door Courthouse), and the costs of mediation shall be shared equally by both parties.

C. Arbitration
If mediation does not resolve the dispute within 30 days, the dispute shall be finally resolved by arbitration in accordance with the Arbitration and Mediation Act 2023.
i. The arbitration shall be conducted by a single arbitrator appointed jointly by the parties, failing which the appointment shall be made by the Chairman of the Chartered Institute of Arbitrators (UK) Nigeria Branch.
ii. The seat of arbitration shall be Lagos, Nigeria (or Abuja, if preferred).
iii. The language of the arbitration shall be English.
iv. The award of the arbitrator shall be final and binding on both parties.

D. Right to Seek Relief
Nothing in this clause prevents Midas Lotto from seeking injunctive or equitable relief in a court of competent jurisdiction where such action is necessary to protect the integrity of the Platform, enforce intellectual property rights, or prevent fraud.

E. Waiver of Class Actions
You agree that any claims or disputes must be brought individually, and you waive any right to participate in class actions, class arbitrations, or other representative proceedings.

i. These Terms shall be governed by and interpreted in accordance with the laws of Nigeria and you irrevocably submit to the non- exclusive jurisdiction of the courts of Nigeria in relation to any dispute in relation to the Terms.

ii. Any bet placed by the User shall be governed by the applicable provisions of the Nigeria Criminal Code Act, CAP. 22, and any regulations and rules made in terms thereof, as amended from time to time. It shall be the responsibility of the User to ensure that he/she is aware of these provisions.

This Terms and Conditions document constitutes the entire agreement between you and Midas Lotto regarding your access to and use of the Website. It supersedes all prior or contemporaneous agreements, communications, representations, or understandings, whether written or oral, relating to the subject matter herein. No amendment or modification of these Terms shall be effective unless it is in writing and published on the Website or otherwise communicated to users in accordance with our update procedures.
